Rulings Regarding Insurance for Employees

Question:

Ustadz (Mr.chaplain), I’d like to ask about the insurance which lately become a trend among society. I know that the ruling for joining the insurance is forbidden due to an element of vagueness inside it (correct me if i’m wrong).

But the question is, what if we are admitted to a health insurance by the company where we work? And the premises are also paid by the company. Is it permissible for us to use that insurance, just as the worker social insurance or the pension?

For your information, our wage is being reduced monthly in a constant percentage for that insurance. Is it permissible for us to join it? And then, are we allowed to take the main amount of thar insurance (which are the amount taken from our wage monthly) at the due time? (usually at the fifth year or at the time we enter our pension days). Or we’re totally not allowed to take the result of such insurance?

Answer:

All praises be to Allah, peace and prayer of Allah be upon Prophet Muhammad, his family, and his devoted companions.

Regarding your question about the insurance Admitted by the company or the governmental institution where you work, below I cite an answer from The Member of Committee of Fatwa, Kingdom of Saudi Arabia:

[Question:]
A store owned by a muslim was extinguished in fire that burnt down all things inside it. Because he has admitted his store in an insurance company since several years ago, the insurance company paid him equal the amount of his loss. What is Allah’s law about the money he received, particularly the amount he had paid for these years is not equal even to the half of what he received. Whereas you’ve already known that some countries have made this insurance compulsory?

[Answer]
This kind of insurance is a commercial one, and it is forbidden, due to vagueness inside it and consuming other people’s wealth in a wrong way. the store owner you’ve mentioned earlier is allowed to take an amount of money that equals the amount he had given to that insurance company. As for the rest of the money, should be spent in charity to help the poor, or in other form of social activities, and he should stop joining the insurance company as soon as possible.

The guidance belong to Allah, prayer and peace of Allah be upon Prophet Muhammad, his family, and his devoted companions.” (Majmu’ Fatawa Al Lajnah Ad Daimah 14/259, in fatwa no: 4862)

Hence, if a claim occurred, you may take some amount of money from that insurance company that equal the amount of money taken from your monthly wage by your company to pay the insurance premise. As for the rest, should be spent in social activities, not by intention of giving alms, but to free yourself from unlawful wealth. And if no claim occurred, you may draw the fee in an amount that equals the total of your monthly wage taken for 5 years or at the time you enter your pension days.

Insurance for Our Future

Question:

Assalamu’alaikum wa rahmatullahi wa barakatuh

Previously, I would like to apologize If my question below create any hard feelings to you.

Ustad (A Mention for religious teacher or scholar in Islam-ed), several years ago I joined an insurance for my children education. Alhamdulillah, all praise belong to Allah, several years after, I began to understand that it was a mistake. But the insurance policy can not be claimed before a certain time. It can be sold, but I must wait for a buyer to come. Finally, I decided to lend that insurance money together with it’s interest, which I meant to use it as a kind of saving, thus, when the policy reach it’s end of the period, the money that I take is my own money, and not the interest.

Now I have moved, and in this new city, the Insurance Office stated that I am now able to claim my policy, but with the amount written upon the policy itself. If I claimed it now, the sum of money I receive will be far from the amount that I have saved.

Ever since I recognized the ruling of insurance, I intended to pay the premises as saving, and not as an insurance. What should I do? Should I claim it now or wait until the amount of policy equals the sum I deposited? I’ve been feeling uneasy lately. If I claimed it now, it means that for all this time, I’ve been paying interests for the credit which I meant to replace the interest (usury) that I will received in the future. But if I did not claim it now, I keep on feeling bad since the money I deposited will be used as a credit containing usury.

I beg you for an advice, to choose a straight path. Thank you.
