A Proper Will in Shari’a

Misunderstanding a will brings fatal effect. Mistake in will means transgression of right. Thus, as a good muslim, we shall understand about this matter, since we’re all heading to our death.

Several days before I wrote this article, I had a conversation with a man who comes from a polygamous family – his father had two wives, and he was his son from the second wife. From the first wife, his father had nine child, whereas from his second wife, he had five child. Before his father died, he wrote a will contains arrangement of division of inheritance of his wealth. Children of the second wife were given inheritance of two locations, whereas children of the first wife were given inheritance of one location but with greater value. This is the example of will that is not allowed in shari’a.

The word “wasiat” (will) is one of the Arabic words that has been adopted in Indonesia language. In its mother language, it means a stressed (emphasized) order.

All praises be to Allah, peace and prayer of Allah be upon Prophet Muhammad, his family, and his companions.

Dear brother! Say:

إِنَّا لِلَّهِ وَإِنَّا إِلَيْهِ رَاجِعُونَ اللَّهُمَّ أْجُرْنِى فِى مُصِيبَتِى وَأَخْلِفْ لِى خَيْرًا مِنْهَا

“‘To Allah we belong and unto Him is our return. O Allah, recompense me for my affliction and replace it for me with something better.’

Our country is again afflicted with calamity. Our muslim brothers are again tried with some hardships. The earthquake once again destroyed the houses, buildings, and killed some of our brothers and wounded some others.

Don’t be down! Keep your kind thoughts of Allah the Exalted, and be tough. Trust me, that if you are tough in going through this calamity, without lamenting, and keep your kind thoughts of this fate, Allah will show you the best solvency to us and our country. Even better, Not only the best solvency, but also this calamity might turn to be pleasures.

وَلَنَبْلُوَنَّكُمْ بِشَيْءٍ مِّنَ الْخَوفْ وَالْجُوعِ وَنَقْصٍ مِّنَ الأَمَوَالِ وَالأنفُسِ وَالثَّمَرَاتِ وَبَشِّرِ الصَّابِرِينَ   {155} الَّذِينَ إِذَا أَصَابَتْهُم مُّصِيبَةٌ قَالُواْ إِنَّا لِلّهِ وَإِنَّـا إِلَيْهِ رَاجِعونَ {156} أُولَـئِكَ عَلَيْهِمْ صَلَوَاتٌ مِّن رَّبِّهِمْ وَرَحْمَةٌ وَأُولَـئِكَ هُمُ الْمُهْتَدُونَ . البقرة 155-157

“We shall certainly test you by afflicting you with fear, hunger, loss of properties and lives and fruits. Give glad tidings, then, to those who remain patient; those who when any affliction smites them, they say: “Verily, we belong to Allah, and it is to Him that we are destined to return.” Upon them will be the blessings and mercy of their Lord, and it is they who are rightly guided.” (Qs. Al Baqarah/The Cow: 155-157)

Brother! Umm Salama -may Allah be pleased with her- said, “I’ve ever heard the Messenger of Allah -peace and prayer of Allah be upon him- said, “Whoever afflicted with calamity, and said:

إِنَّا لِلَّهِ وَإِنَّا إِلَيْهِ رَاجِعُونَ اللَّهُمَّ أْجُرْنِى فِى مُصِيبَتِى وَأَخْلِفْ لِى خَيْرًا مِنْهَا

“Allah will grant him rewards in that calamity and replace for him a better one than what he lost.” And when my husband, Abu Salama died, I uttered the prayer, as taught by the Messenger of Allah -peace and prayer of Allah be upon him- and in fact, Allah replaced for me one who was better than Abu Salama, that is the Messenger of Allah -peace and prayer of Allah be upon him-.” (Narrated by Al Bukhari)

It is true that after the waiting time for a widow of Umm Salama passed, the Messenger of Allah -peace and prayer of Allah be upon him- sent someone to propose to Umm Salama to be his wife.
